Trust and probate litigation
Problems may arise in any estate or trust. It is important to obtain good advice from the outset. The powers of the courts to award costs against the parties, and increasingly against executors and trustees, require serious consideration.
Probate actions
Wills can be contested on a number of grounds. The Will may lack proper formality. The testator may have lacked capacity or knowledge and approval of what he or she signed. The testator may have been unduly influenced.
Inheritance claims.
English law allows in certain circumstances a claim by a spouse or partner or a financial dependant for provision out of an estate. There have been recent cases that have awarded adult children a claim.

Trust disputes
Matters may be resolved by an application to the courts for guidance. They may develop into claims for breaches of trust.
